Rental Terms & Conditions

These Rental Terms & Conditions, together with your Rental Agreement, Cancellation & Refund Policy, Refund Schedule & Rebooking Credit Option and any electronically executed addenda, waivers, disclosures or acknowledgments (collectively, the “Agreement”), constitute a legally binding contract between Denali Backroads Adventures, LLC, doing business as Denali Backroads (“Denali Backroads,” “we,” “us,” or “our”) and you, the Renter.

By completing a reservation, submitting payment and executing this Agreement electronically, you acknowledge that you have read, understood and agree to be bound by all terms set forth below.


1. Definitions

Renter / You
The individual(s) identified on the Rental Agreement as financially and legally responsible for the Vehicle.

Vehicle
The rented automobile, SUV or 4×4 vehicle, including all keys, tires, tools, accessories, installed equipment and any optional or add-on items.

Rental Period
The period beginning at the date and time of Vehicle pickup and ending at the date and time of Vehicle return.

Agreement
This Rental Agreement, these Terms & Conditions and all incorporated policies, schedules, addenda and acknowledgments.


2. Eligibility & Authorized Drivers

  • The minimum age to rent or operate the Vehicle is twenty-five (25) years.

  • All drivers must possess a valid, current, non-suspended driver’s license.

  • International renters may be required to present a passport and an International Driving Permit (IDP).

  • Only drivers expressly listed and approved on the Rental Agreement may operate the Vehicle.

Denali Backroads may deny, cancel or terminate a rental if a driver does not meet eligibility requirements or if information provided is incomplete, inaccurate or indicates an unreasonable safety or compliance risk.

Operation of the Vehicle by any unauthorized driver constitutes a material breach of this Agreement and voids all optional waivers and protections.


3. Identity Verification

Identity verification is required prior to Vehicle release.

If verification cannot be completed or reasonably confirmed, Denali Backroads may delay, deny or cancel the rental. Denali Backroads is not responsible for delays or failures caused by third-party verification services.


4. Insurance Requirements & Verification

The Renter is required to maintain valid automobile liability insurance that meets or exceeds Alaska statutory minimum requirements.

Insurance verification may be required prior to pickup. Verification does not represent or guarantee coverage applicability.

Renters unable to demonstrate qualifying coverage may be required to purchase Supplemental Liability Insurance (SLI) as a condition of rental.


5. Authorized Use & Operating Restrictions

Use of the Vehicle is limited to lawful, personal, recreational travel.

The following uses are strictly prohibited:

  • Commercial use, rideshare or delivery services

  • Racing, speed testing or competitive driving

  • Illegal activity or transport of contraband

  • Towing unless expressly authorized in writing

  • Operation by unauthorized drivers

  • Driving outside of Alaska, Exception: Canada only with authorization

Travel into Canada is permitted only with prior approval from Denali Backroads and may be subject to additional requirements, documentation or restrictions.

If cross-border travel is approved:

  • The Renter is responsible for complying with all Canadian laws, regulations and entry requirements
  • The Renter must carry all required documentation, including but not limited to:
    • Valid passport
    • Driver’s license
    • Insurance documentation acceptable for use in Canada
  • The Renter is responsible for any fees, fines, delays or issues arising at border crossings

Travel outside of Alaska and Canada is strictly prohibited.

Denali Backroads reserves the right to deny or revoke cross-border travel authorization at its sole discretion. Any unauthorized travel outside approved areas constitutes a material breach of this Agreement and may result in: 

  • Termination of the rental
  • Loss of coverage
  • Full financial responsibility for any damages, recovery or associated costs

 

Any prohibited use constitutes a material breach of this Agreement.


6. Road, Terrain & Route Restrictions

Permitted use includes publicly accessible, maintained roads, including paved highways and maintained gravel roads.

The following uses are strictly prohibited:

  • Off-road driving or travel on unmaintained trails

  • Rock crawling or extreme terrain

  • Water crossings above wheel-hub height

  • Travel on glaciers, river ice or tidal flats

  • Travel on closed, restricted or emergency-only routes

All costs associated with recovery, towing, extraction, storage and resulting damage arising from prohibited use are the Renter’s responsibility.


7. Winter & Cold-Weather Operations

Travel in Alaska during winter and shoulder seasons involves inherent risks, including extreme cold, snow, ice, limited services and rapidly changing conditions.

The Renter is responsible for operating the Vehicle in a manner appropriate to conditions and for following provided operating guidance.

Damage resulting from improper operation, failure to follow cold-weather procedures or neglect - including frozen components, fuel gelling or battery damage - may be deemed misuse and remain the Renter’s responsibility.


8. Vehicle Condition, Damage, Loss & Downtime

The Renter accepts the Vehicle in good condition unless otherwise documented at pickup.

The Renter is financially responsible for:

  • Physical damage or loss

  • Recovery, towing and storage

  • Reasonable administrative fees

  • Loss of use during repair or replacement

  • Reasonable diminution of value resulting from damage

Responsibility applies regardless of fault, except where prohibited by applicable law.


9. Fees, Charges, Security Deposit & Payment Authorization

A security deposit authorization will be placed prior to Vehicle pickup.

By booking and executing this Agreement, the Renter authorizes Denali Backroads to charge the payment method on file for all amounts owed, including:

  • Rental charges and approved extensions

  • Damage, repairs or loss

  • Cleaning, recovery and storage

  • Administrative fees

  • Traffic, parking or toll violations

A Fee & Damage Schedule is incorporated by reference and disclosed prior to or at Vehicle pickup.


9A. Reservation Payment, Cancellation & Refund Policy

All reservations require 100% payment at the time of booking. Payment capture constitutes acceptance of this Agreement.

Cancellations, refunds, credits and eligibility are governed exclusively by:

  • Denali Backroads Cancellation & Refund Policy

  • Refund Schedule & Rebooking Credit Option

Unless expressly stated in writing:

  • No refunds are provided for early returns

  • No refunds are provided for weather, road closures or travel disruptions

  • No refunds are provided for verification failure or policy violations


10. Termination & Repossession

Denali Backroads may terminate this Agreement and recover possession of the Vehicle if the Renter violates this Agreement, provides materially false information or operates the Vehicle in an unsafe or prohibited manner.


11. Assumption of Risk

The Renter acknowledges that travel in Alaska involves inherent risks, including remote conditions, severe weather, wildlife encounters, limited emergency services and variable road conditions.

The Renter knowingly assumes these inherent risks to the extent permitted by law, except for risks arising from Denali Backroads’ gross negligence or willful misconduct.


12. Indemnification

To the fullest extent permitted by law, the Renter agrees to defend, indemnify and hold harmless Denali Backroads from all claims, damages, losses, liabilities and expenses arising out of the rental or operation of the Vehicle, except to the extent caused by Denali Backroads’ gross negligence or willful misconduct.


13. Limitation of Liability

To the maximum extent permitted by Alaska law, Denali Backroads shall not be liable for indirect, incidental, special or consequential damages arising out of or related to this Agreement or the rental or use of the Vehicle.

Nothing in this Agreement limits liability that cannot be limited under applicable law.


14. Governing Law & Venue

This Agreement is governed by the laws of the State of Alaska.

Exclusive venue and jurisdiction shall lie in the state or federal courts located within the Fairbanks North Star Borough, Alaska, and the parties knowingly waive any objection to such venue.


15. Severability

If any provision of this Agreement is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.


16. Electronic Execution & Records

This Agreement may be executed electronically.
Electronic signatures, acceptance records, timestamps, IP addresses and payment authorizations are legally binding and may be retained for dispute resolution, audit and Stripe chargeback defense.


17. Entire Agreement & Modification

This Agreement constitutes the entire agreement between the parties concerning the rental of the Vehicle.
No modification is valid unless made in writing or electronically executed by Denali Backroads.



Denali Backroads – Cancellation & Refund Policy

This policy is incorporated by reference into the Rental Terms & Conditions and applies to all reservations.


1. Payment at Booking

100% of rental charges are captured at the time of booking.
Booking constitutes acceptance of all governing documents.


2. Governing Refund Rules

Refunds, partial refunds, credits and eligibility are governed by the Refund Schedule & Rebooking Credit Option in effect at the time of booking, which is presented during checkout and incorporated by reference.

The applicable policy version is locked at booking and does not change retroactively.


3. Cancellation Requests

Cancellations must be submitted in writing.
The date/time received determines eligibility.


4. Non-Refundable Circumstances

Unless expressly authorized in writing:

  • Early returns

  • Weather or forecasts

  • Road closures

  • Mechanical issues

  • Airline or travel disruptions

  • Verification failure

  • Policy violations


5. Denali Backroads-Initiated Cancellations

Denali Backroads may cancel reservations for safety, availability, verification failure or events beyond control and may issue a refund or rebooking credit at its discretion.


6. Evidence & Acceptance

This policy is presented prior to payment.
Acceptance records, timestamps, IP addresses and payment authorization may be retained for dispute resolution.



Denali Backroads – Refund Schedule & Rebooking Credit Option


1. Cancellation Timing & Refund Amounts

2. Rebooking Credit Option

In lieu of a cash refund, Denali Backroads may, at its sole discretion, offer a rebooking credit.

If offered and accepted:

  • Up to 100% of rental charges

  • Non-refundable

  • Not redeemable for cash

  • Valid 12 months from original pickup date

  • Subject to availability and current rates

  • Non-transferable unless approved in writing

Acceptance constitutes full and final resolution of any refund or dispute.


3. Refund Processing

Authorized refunds:

  • Issued to original payment method

  • Processor fees non-refundable

  • Administrative fees may apply

  • 5–10 business day processing window


4. Policy Acknowledgment

By booking, the Renter acknowledges:

  • This schedule was presented prior to payment

  • The Renter had an opportunity to review it

  • The Renter accepted it as part of the rental contract

Records are retained for Stripe and card-network evidence.
